1. Preamble
These General Conditions of online Sale regulate the sale and purchase agreement of the products (here in after, the "Product" or "Products") offered by Dopa Interiors S.r.l., through the Website www.dopainteriors.com (here in after "Website") to the Website’s users (here in after, the "Customers" or "Customer").


The offer and the sale of Products through this online shop is proposed by the company Dopa Interiors S.r.l., and are drawn up in compliance with the regulations on electronic commerce and distance sale contracts.


Dopa Interiors S.r.l. is an official authorized dealer of all the Brands on this Website.

2. Acceptance of General Conditions of Sale
By placing an online purchase order, the Customer accepts unconditionally and is also responsible to abide by the General Conditions, with Dopa Interiors S.r.l. The Customer also declares to have observed and accepted all the contents presented and all other information on the Website. Furthermore, the application of any clauses is excluded, unless however in compliance with the rules and regulations of Dopa Interiors S.r.l.

 


3. Prices and Products features
Deliveries outside of the EU do not include taxes and duties. These will be charged to the Customer and will be asked for by the carrier. The destination country set by the Customer shall prevail.

The price stated at the moment of purchase is fixed and definitive.

Prices presented on the Website by Dopa Interiors S.r.l. cancel and replace the previously stated ones, and are subject to Products availability.
Technical and functional features of the Products published by Dopa Interiors S.r.l. contained in this Website and messages, are those sent by the manufacturers. Dopa Interiors S.r.l. is not liable for the truthfulness and completeness of the information. Products images are for illustrative purpose only and not binding.

It is not possible to send Products for testing. Although Dopa Interiors operators can provide Customers with information on the Products, the Customer is responsible for the choice of the Products ordered and for their conformity.

Site information may be not complete. For example, it is not necessarily said that fireproof or specific technical standards are indicated.
The Customer is responsible for verifying the import possibility of ordered Products and for import formalities into his own country.


4. Payments

Payment must be made only in a single solution at the time of order, in one of the currencies chosen from those available on the Website.

If payment is not received within 5 days from the order, Dopa Interiors will have to consider the order as cancelled. The effective order taking charge will take place only after the due amount has been credited to the Dopa Interiors account.

By registering, you can buy quickly, keep up-to-date on order status, and review the history of your purchases.
Site registration and all purchase phases are protected by a 256-bit SSL certificate.





PayPal & Credit card

We have chosen PayPal as a platform for electronic payments to provide flexibility and security.

You can use your PayPal account or, without signing up, use one of the PayPal managed credit cards.

 

PayPal protects credit card payments and guarantees them with technology and coding systems – more security details.

 

In case of payment through the standard PayPal mode, at the end of the order you will be directed to the PayPal login page to proceed with payment.

Taxes and duties
Please remember that international deliveries outside the European Union do NOT include customs & clearance fees, duties & taxes, and any other local tax.
Dopa Interiors S.r.l. can offer, on request, for some countries, a free service of taxes and duties estimate. Dopa Interiors points out that it is only an estimate. The official source remains your local Customs Office.
Our courier offers advance payment of taxes and duties on behalf of the Customer. Amounts due by the Customer must be paid to the courier.
In no case Dopa Interiors S.r.l. is liable for taxes and/or duties reimbursements.

 


5. Orders and Billing
Each order placed represents a contractual proposal by the Customer. Fulfilment of the order by Dopa Interiors S.r.l. represents its confirmation and acceptance.
Fiscal documents related to orders will be issued by Dopa Interiors S.r.l. at the time of dispatching Products to the Customers.
The invoice will be issued by Dopa Interiors S.r.l. The Customer will have to specify the exact necessary data and the billing address.

 


6. Order acceptance
The conclusion of the agreement will only take place at the moment of the order confirmation by Dopa Interiors S.r.l.
The Customer will be notified of the acceptance by e-mail. The message will state the order confirmation with the elements of the agreement.
Dopa Interiors S.r.l. reserves the right to not confirm or revoke any order for whatever reason, especially if involving Products supply problems or the order itself.

 


7. Order fulfilment
The order will be fulfilled according to the terms stated on the Website.
Once an order is confirmed, it can be cancelled by the Customer only within 24 hours, at the end of which the Customer is obliged to pay for the order. In accordance with the laws, our Customers can withdraw froml the contract within 14 (fourteen) days of receipt, as our return policy states (see "Right to Cancel").
If the order has not been executed (in the event of unavailability of the Product ordered), Dopa Interiors S.r.l. will inform the Customer as soon as possible about the delivery time, depending on the Product availability.
In the event of breakage, stock depletion or unavailability of the ordered Product, Dopa Interiors S.r.l. will inform the Customer as soon as possible, stating a new deadline for Product availability. The Customer will send an e-mail confirmation for his/her choice, of whether to wait for the Product supply or to request a refund.
Operations can start after the payment confirmation is received: bank transfers are attested by the credit on our current account; credit card / PayPal payments are attested by the transaction confirmation by the circuit.

 


8. Shipping
We deliver worldwide. All items will travel with a free shipping insurance included.


Moreover, shipping to an Italian destination is free too.


We deliver through qualified express carriers.


Dopa Interiors S.r.l. reserves the right to deliver the Products through a courier selected by Dopa Interiors S.r.l.

 

  • How much is the shipping cost?
    Shipping cost varies depending on the destination country and is available during the checkout process. The total cost we provide includes express shipping, street level.
  • Can I specify a different address from my domicile for shipping?
    Yes, Products are shipped to the address stated by the Customer. You can specify a different address from your domicile when you are shopping. It is a perfect solution to send gifts to friends or relatives.

  • It’s not possible to deliver to PO boxes?
    Products may not necessarily be delivered directly to consignee, since the shipper can deliver it to people who may be authorized to accept the goods (e.g. a janitor, ware-houseman, receptionist, etc.).

  • Taxes, duties with regard to shipment
    Taxes and fees also depend on the destination country.
    For non-EU countries, taxes and duties - if any - are charged to the Customer and NOT included in the price shown on the Website. The destination country set by the Customer shall prevail.
    With regard to VAT, other local taxes and custom duties and fees - if any - our courier's customs broker will contact you by phone or email as soon as the goods arrive to inform you about the amount and payment methods, providing a step by step assistance.

    Our Freight Forwarder provides advance payment of taxes and duties at the time of customs clearance. Please contact us to get an estimate.

  • How can I check the status of my shipping?
    As soon as the Products have been shipped, you will be informed by e-mail. In order to let you follow the shipment step by step, you will also receive the tracking number.

 


9. Product delivery
Our aim is delivering the Products as soon as possible, in relation to the actual stock or production availability. For that reason we use qualified express couriers.

  • How long is the delivery time?
    On average, delivery time range is 4/6 weeks.
    Delivery time varies depending on the ordered good and the current production situation of the parent company or store.
    Delivery time depends on various factors and delivery delays are not the responsibility of Dopa Interiors. No one can claim for damage caused by delayed delivery.

    Please note that all delivery dates on the Website are estimates only and do not include holidays and extended holidays.

  • Delivery on street level and Assembling
    Deliveries are to be intended on street level: Products will not be delivered on the Customer's floor and we will not take any trade-ins.
    Special delivery terms and conditions must be previously agreed upon between the Customer and Dopa Interiors S.r.l., and accepted in writing by Dopa Interiors S.r.l.
    Unless otherwise specified or agreed in written form, Dopa Interiors S.r.l. does not offer any assembly service. Most of our Products are delivered in pre-assembled form.

    On delivery, the Customer must verify the content of the package, the conformity and state of the Product(s). Dopa Interiors S.r.l. recommends verifying the overall state of the Product(s) before signing the delivery note. In particular, the Customer must verify that:

 

- number of parcels corresponds to that stated in the enclosed delivery note;

- package is intact, neither damaged nor wet or adulterated, and the content undamaged.


Should the Customer note any anomalies, delivery of the Products must be refused or detailed reserves must be put in writing and dated. Once the Customer signs the delivery note with no "reserve", he/she will not be able to question the external conditions of the delivered Product. Issues about integrity, correspondence or completeness of the Products received must be notified within three 3 (three) days from the delivery.



10. Product delivery – In case of immediate returning of Product caused by broken or visibly damaged packaging
Should the Customer receive the packages visibly damaged by the transport and/or carrier (broken or visibly damaged packaging), it will proceed as follows:

  • If there are more packages, dismiss only the damaged package to the sender. It will then be our responsibility to contact the Customer and arrange replacement and/or refund;
  • If it is a shipment of a single package, dismiss it to the sender and will be then our responsibility to contact the Customer and arrange replacement and/or refund.


In the event that the damaged Product is discontinued or no longer available, the Customer will be contacted for a possible replacement item of equal value and features available, or alternatively for the return of the paid amount.

 


11. Damage in transit
Our team will check that every item in your order is carefully packed before shipping. However, damages in transit can happen, so we ask you to please check the Products very carefully.

  • What to do in case some Product(s) are damaged in transit?
    In case your order arrives damaged, you must refuse to accept the damaged Products or sign the delivery slip with the note "Product damaged/broken".
    Please inform the carrier as well as our Customer Service immediately in written form about the damages within 3 (three) days upon receipt. You can write an email to info@dopainteriors.com.

  • What to do if you accepted Products despite our recommendation and they happen to be damaged?
    In this case we ask you to please send us some photos of the damage by email stating your invoice number, so that we can send a damage report for our insurance in the right time and in the right form. At the same time we will arrange the return of the goods with you.

12. Product pick up - Customer's absence
In case the Products could not be delivered to the address provided by the Customer during the order process, the courier will leave a note stating address and method for collecting the package.
If the Customer does not collect the package within the deadline indicated by the courier, Products will have to be returned, carriage paid to Dopa Interiors S.r.l., that reserves the right to refund the Customer for the price of the Product, minus all charges for shipping.

 

 

13. Force majeure
The following cases are to be considered as force majeure, apart from those specified by law: total or partial strikes, internal or external to the Company, stop of means of transport or provisions for any reason, governative or legal restrictions, computer breakdowns, telecommunication halt included networks and the Internet.

Force majeure will cause the suspension of the order.

If after 3 (three) months parties observe the persistence of the force majeure, the order will be automatically cancelled, unless otherwise agreed.

 


14. Products warranties - Technical assistance
Possible defects covered by the Dopa Interiors S.r.l. Warranty, on Products damaged in transit, must be reported by the Customer not later than 3 (three) days from the date of delivery. In case the Dopa Interiors S.r.l. Warranty can be applied, the Customer has the right to have his damaged Products replaced after returning them, excluding any right for compensation for any further damage. The necessary shipping costs to replace the items are covered by Dopa Interiors S.r.l.


Taking for granted everything on previous point, Dopa Interiors S.r.l. does not offer any further warranty than that given by the single manufacturers of the Products here commercialized. The technical assistance and all the repairs of the Products covered by the warranty, when provided, are taken care of by the single manufacturers, according to the terms and the forms reported on the papers attached to Products themselves. In particular, Dopa Interiors S.r.l. neither offers any warranty on the compatibility of Products with other items or devices used by the Customer, nor offers any warranty on the Products suitability for any use conceived by the Customer.


Except for the supposition of fraud or of an important guilt, it’s from now settled that, should be recognized the responsibility of Dopa Interiors S.r.l. towards any claim of the Customer - including the partial or full non-execution of the obligations assumed by Dopa Interiors S.r.l. towards the Customer regarding the execution of an order – the responsibility of Dopa Interiors S.r.l. cannot be higher than the price of the Products purchased by the Customer and about which a contestation was raised.

 

 

15. Replacement / Returning faulty Products
The replacement of the defective Products or parts requires time just below or even equal to that of production since it is almost always produced to order. The practice of substitution will be initiated as soon as we receive the photographic record from the Customer, which must be received not later than 3 (three) days from the date of delivery. Any possible replacement of the Products produced to order will not be made if the purchaser seeks deviations from the colours and/or shades of fabrics, leather, metals, wood, glass and stone published on the Website.


Our commitment will operate with the utmost speed in order to reduce waiting times.
Defective Products or parts, must be returned to Dopa Interiors S.r.l. within 10 (ten) days after the delivery.
The postage and packaging for the return shipment should be charged to Dopa Interiors S.r.l.


Defective merchandise will be returned or refunded if the replacement with the same Product is not possible.

16. Received Wrong Product
In the event of a wrong Product delivered, the Customer is in charge of returning the Product(s) to Dopa Interiors S.r.l. within 7 (seven) days from delivery, in the original and intact packaging, with its delivery note.


Once the Product is received in its correct form, Dopa Interiors S.r.l. will send at its own expenses the Product initially ordered.

17. Right to cancel
According to the clause 5 of the Legislative Ordinance number 185 of the 22nd of May 1999, the Customer (if recognized as “Consumer” according to the clause 1, letter B, of the "D.Lgs. 22 maggio 1999 n. 185") has the right to withdraw from the contract and to send back the Products ordered, with no penalty and without specifying the reasons, not later than 14 (fourteen) days from the delivery time.
The Right to Cancel the contract of sale can be exercised by the Customer within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which the Customer acquires, or a third-party other than the carrier, physical possession of the Products.


To exercise the right to cancel, the Customer must inform Dopa Interiors S.r.l. of his/her decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail). The Cancellation form can be used, but it is not obligatory.
To meet the cancellation deadline the Customer must to send his/her communication concerning the exercise of the right to cancel before the cancellation period has expired.

 

The right to cancel does not apply to the following kind of contracts:

  • Contracts for the supply of goods that are made to the consumer’s specifications or are clearly personalised;
  • Contracts for the supply of goods which are liable to deteriorate or expire rapidly;
  • Contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
  • Contracts for the supply of goods which are, after delivery, according to their nature, inseparably mixed with other items.


Effects of cancellation
Should the Customer cancel this contract, we will reimburse to the Customer all payments received, including the costs of delivery (except for the supplementary costs arising if the Customer has chosen a type of delivery other than the least expensive type of delivery offered by us).

We will make the reimbursement using the same means of payment as used for the initial transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not incur any fees as a result of the reimbursement.
Refund may be suspended until receipt of Products.
The Customer shall ship back the Products to the Italian address, that will be indicated by Dopa Interiors Customer Service, without undue delay and in any event not later than 14 (fourteen) days from the day on which the Customer communicates the cancellation from this contract to us. The deadline is met if the Customer sends back the Products before the period of 14 days has expired.

Please make sure that the returned products are in resalable condition.


All returns (which should be perfectly intact) must be authorized by the Customer Service. The Product must not have suffered damages and it must be in a state of cleanliness.


All returning shipping costs will be charged to the Customer. After the receipt, Dopa Interiors will examine the Products to verify the existence of any damages (the substantial integrity is an essential condition for the exercise of the right of withdrawal). If the Product have been damaged during the transport, then Dopa Interiors will inform the Customer (within 5 working days from the receipt of Product in their stores), to enable the Customer to do a timely complaint against the carrier chosen by the Customer and get a refund of the value of the Product (if insured). In this case, the Product will be made available to the Customer for the return, simultaneously cancelling the request of withdrawal.

18. Failure to pay - Conditional sale
Products ordered are property of Dopa Interiors S.r.l. until the definitive and complete payment of their price (Art. 1523 and following of the Civil Code). Dopa Interiors S.r.l. reserves the right to demand the Products ordered in case of failure to pay.
In this event and by request of Dopa Interiors S.r.l., the Customer commits to return any non-paid item or paid in a fraudulent way, at his/her own expenses.

 


19. Claims
Claims for non-compliance of delivered Product(s) with the order must be sent in writing to Dopa Interiors S.r.l., immediately after receiving the Products.
The Customer must keep the original packaging and the delivery note.

 

 

20. Privacy Policy

PERSONAL DATA TREATMENT POLICY
The personal data of the Users of Website or Clients are used by Dopa Interiors S.r.l., Via Don Guanella 15/G, 70124 Bari (BA), Italia, which is the holder for the treatment, in compliance with the principles of protection of personal data established by the GDPR 2016 Regulations / 679.

 


AIMS AND MODALITY OF DATA TREATMENT
1) We inform you that the data will be processed with the support of the following means:

  • Paper (registration forms, order forms, etc.);
  • Informatics (management software, accounting, etc.);

  • provision of the services requested by the Client or available on portals managed by Dopa Interiors S.r.l. (personnel selection, newsletter, informative material, complimentary material) and conclusion of the contract to which the interested party belongs;

Any refusal to allow the processing of data implies the impossibility of using the service requested by the user.

Subject to explicit denial by the party concerned, the user's data will also be processed for the following purposes:

  • sending of proposals and commercial communications by e-mail, by Dopa Interiors S.r.l.;
  • market surveys and statistics, marketing and references on advertising (press, radio, TV, internet, etc.), product preferences.


LEGAL CONNOTATIONS
2) The provision of data is mandatory for all that is required by the legal and contractual obligations and therefore any refusal to supply them in whole or in part may provide the requested service.

The company processes the user's optional data on the basis of consent, through the explicit approval of this Privacy Policy.

These General Conditions of Sale represent all obligations of the parties. No other general or special term and conditions communicated by the Customer shall neither be included in, nor depart from these General Conditions.

 

 

24. Intellectual and industrial property rights
Dopa Interiors S.r.l. informs that the Website, as well as all the trademarks and logos used in connection with the sale of the Products offered, are protected by applicable intellectual and industrial property rights and that any kind of reproduction, communication, distribution, publication, alteration or transformation is forbidden, in any form or for any purpose they occur.

 

 

25. Nullity
Should one or several clauses of these General Conditions be considered as being non-valid or is declared to be so in accordance with an act, a rule or pursuant to definitive ruling of a competent court, the remaining clauses will remain valid.

 

 

26. Alternative dispute resolution
Since 15 February 2016 a new online platform launched by the European Commission is available to help consumers and traders solve online disputes over both domestic and cross-border online purchases. 27. Applicable law and Competent court
The contract of sale between the Customer and Dopa Interiors S.r.l. is concluded in Italy and governed by the Italian law.
In the event of a dispute and where no amicable settlements were reached between the parties, where applicable mandatory dispositions of law related to consumer protection (as in art. 1, letter B of "D.Lgs. 22 maggio 1999 n. 185"), any controversy linked to these General Conditions will be of exclusive competence of the Court of Bari (Tribunale di Bari, Italy).
Pursuant to and by effect of clauses no. 1341 and 1342 of the Civil Code, the Customer declares to have accurately read, understood and accepted specifically the following clauses of these General Conditions of Sale of Dopa Interiors S.r.l.: 1 - 2 - 3 - 4 - 5 - 6 - 7 - 8 - 9 - 10 - 11 - 12 - 13 - 14 - 15 -16 -17- 18 - 19 -20 - 21 - 22 - 23 - 24 - 25 - 26 -27.
